I don't think it's physically possible for a gun that's pointing downwards to turn on its own and suddenly point towards that woman's torso. Many police don't feel "dressed" if they don't have a gun on them, though most off duty officers I've know carry a smaller, concealed weapon. Either under their shirt / jacket in the back or an ankle piece. She hugged him from behind, he's carrying the pistol on his belt in a soft holster many of which swivel, I can see her reaching around him, pushing the gun forward, causing it to swivel so it's pointing up; he, being surprised, pushes the gun back into the holster triggering it at the same time. A calamitous disaster, but possible. The stupidity of the situation is that it need not have happened at all, you don't keep the hammer on a chamber with a round in it or if it's an automatic, you don't keep a round in the chamber - that's absolutely dumb and just asking for this type of accident. It seems very strange that you would carry a gun to a garden party at your own house let alone a .40 calibre gun with no safety is asking for trouble.
